These rules are a direct implementation of Colorado\u2019s Accessibility Law, <a href=\"https:\/\/leg.colorado.gov\/bills\/hb21-1110\" target=\"_blank\" rel=\"noreferrer noopener\">HB21-1110<\/a>,and provide the detailed requirements and enforcement framework that make HB21-1110 actionable.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>The rules are designed to ensure that state and local governments\u2014and the agencies, departments, and public entities they oversee\u2014provide digital experiences that are fully accessible to people with disabilities. <\/p>\n\n\n\n<p>Requirements align with the Web Content Accessibility Guidelines (WCAG) 2.1 <a href=\"https:\/\/allyant.com\/blog\/difference-between-wcag-2-a-aa-explained\/\">Levels A and AA<\/a>, exceeding the WCAG 2.0 standard required for compliance with Section 508 of the Rehabilitation Act. If full compliance isn\u2019t technically feasible, accommodations must still be provided\u2014balancing accessibility with security, privacy, interoperability, and user needs.&nbsp;<\/li>\n\n\n\n<li><strong>Alternative Formats and Effective Communication: <\/strong>Public entities <strong>must offer alternate formats or auxiliary aids<\/strong> at no cost, upon request. Alternate versions must be equally functional and up to date. These alternate versions must be equivalent in content, functionality, and timeliness.<\/li>\n\n\n\n<li><strong>Accessibility Statement:<\/strong> Each public entity must post a <strong>public-facing accessibility statement<\/strong> outlining:\n<ul class=\"wp-block-list\">\n<li>A commitment to accessibility.&nbsp;<\/li>\n\n\n\n<li>How users can request accommodations or alternate formats.&nbsp;<\/li>\n\n\n\n<li>How to report digital accessibility issues<\/li>\n\n\n\n<li>Contact information for accessibility personnel.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-large-font-size\">Demonstrating Compliance\u00a0<\/h2>\n\n\n\n<p>Entities subject to HB21-1110 may demonstrate compliance through several means, including:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ensuring applicable communications meet WCAG technical standards.&nbsp;&nbsp;<\/li>\n\n\n\n<li>Providing alternate formats or accommodations.<\/li>\n\n\n\n<li>Publishing a publicly available Accessibility Plan demonstrating ongoing good faith efforts toward compliance.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-large-font-size\">Exemptions\u00a0<\/h2>\n\n\n\n<p>Entities may apply for exemptions if they can demonstrate that compliance would cause:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An undue burden (significant difficulty or expense),<\/li>\n\n\n\n<li>A fundamental alteration of the program or service, or<\/li>\n\n\n\n<li>A direct threat to the health or safety of others.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-large-font-size\">Meeting Compliance Requirements\u00a0<\/h2>\n\n\n\n<p>The deadline for compliance is June 30, 2025.
