The ACA became law in 2019 and has long required covered organizations to take a programmatic approach to accessibility\u2014through planning, feedback, and progress reporting.&nbsp;&nbsp;<\/p>\n\n\n\n<p>However, in 2025 Canada introduced&nbsp;new Digital Accessibility requirements. These new requirements&nbsp;build on the original&nbsp;foundation by adding more specific expectations for web pages, training, and recordkeeping, and (for some organizations) mobile apps, digital documents, procurement checks, and accessibility statements\u2014with compliance milestones beginning in December 2027 and December 2028.&nbsp;<\/p>\n\n\n\n<p>Learn more about the ACA, including who must&nbsp;comply,&nbsp;standards and documentation requirements, and how&nbsp;Allyant&nbsp;supports&nbsp;ACA compliance.&nbsp;&nbsp;<\/p>\n\n\n\n<div style=\"height:39px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading has-black-color has-text-color has-link-color has-large-font-size wp-elements-410170bfd79fd7c28361dc9d4f3d1b83\"><strong>Background of the ACA\u00a0<\/strong><\/h2>\n\n\n\n<p>The ACA takes a proactive approach. Instead of waiting for complaints, organizations are expected to build accessibility into how they design services, deliver communications, and purchase technology.&nbsp;<\/p>\n\n\n\n<p>Canada\u2019s regulations under the ACA already require organizations to plan and report on accessibility. Newer updates add more explicit requirements for digital technologies (often described as the first major \u201cdigital accessibility\u201d phase).&nbsp;<\/p>\n\n\n\n<div style=\"height:39px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading has-black-color has-text-color has-link-color has-large-font-size wp-elements-c4d86f2af3f26bf4370ce538b3e4b6f5\"><strong>Who Must Comply with the ACA and its Digital Accessibility Rules?&nbsp;<\/strong><\/h2>\n\n\n\n<p>The ACA applies to the federal public sector and to federally regulated organizations in Canada. That coverage is narrower than \u201call Canadian organizations,\u201d so confirming whether your organization is federally regulated is a key first step.&nbsp;<\/p>\n\n\n\n<p>In this context, federally regulated&nbsp;generally means&nbsp;your organization&nbsp;operates&nbsp;in an industry or activity under federal&nbsp;jurisdiction&nbsp;(rather than provincial or territorial regulation). Many federally regulated organizations fall under the same jurisdictional umbrella used for federally regulated workplaces.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-4aa1bbd9d43fd0f881de641e0d630d81\"><strong>Federally regulated organizations<\/strong><\/h3>\n\n\n\n<p>Federally regulated organizations commonly include:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Banks and authorized foreign banks.&nbsp;<\/li>\n\n\n\n<li>Telecommunications and broadcasting.&nbsp;<\/li>\n\n\n\n<li>Transportation that crosses provincial or international borders (air, rail, marine, interprovincial trucking\/busing), plus related infrastructure.&nbsp;<\/li>\n\n\n\n<li>Postal and courier services.&nbsp;<\/li>\n\n\n\n<li>Many federal Crown corporations.&nbsp;<\/li>\n\n\n\n<li>The federal public sector (including federal departments and agencies).&nbsp;<\/li>\n\n\n\n<li>Businesses that are vital, essential, or integral to one of the earlier mentioned federally regulated activities.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-fc84c99f2bd9735de0104d716a805c1a\"><strong>What about retail \/ commerce?&nbsp;<\/strong><\/h3>\n\n\n\n<p>Retail and general commerce are usually not federally regulated simply because they sell to the public. Most retailers are regulated at the provincial\/territorial level.&nbsp;<\/p>\n\n\n\n<p>However, parts of a commerce ecosystem can be federally regulated when they&nbsp;operate&nbsp;as federal-jurisdiction industries\u2014examples include banking\/financial services, telecom, and interprovincial shipping\/courier.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-68533ca0cca9d4bbca4e46e46d3553ff\"><strong>What about healthcare services?&nbsp;<\/strong><\/h3>\n\n\n\n<p>Most healthcare service delivery (hospitals, clinics, providers) is typically regulated by provinces and territories,&nbsp;not&nbsp;the federal government\u2014so it is often not federally regulated for ACA purposes.&nbsp;<\/p>\n\n\n\n<p>Healthcare may fall under ACA coverage when it is delivered by the federal public sector or by a federally regulated entity.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-d1695c0413907b2e26e22d60fe830bbc\"><strong>A&nbsp;practical&nbsp;note for&nbsp;retail and&nbsp;healthcare&nbsp;organizations&nbsp;<\/strong><\/h3>\n\n\n\n<p>Even when ACA does not apply, retail and healthcare organizations may still have provincial accessibility obligations (and contractual or customer-driven requirements). Two common examples:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ontario: <a href=\"https:\/\/allyant.com\/compliance\/aoda-compliance-the-accessibility-for-ontarians-with-disabilities-act\/\" title=\"\">Accessibility for Ontarians with Disabilities Act<\/a> (AODA).&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Manitoba: Accessibility for Manitobans Act (AMA).&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>If your organization&nbsp;operates&nbsp;across Canada,&nbsp;it\u2019s&nbsp;common to have both federal and provincial accessibility considerations.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-18342cf604164ba0869ab7aef2f590da\"><strong>Employee-count&nbsp;thresholds in the&nbsp;digital&nbsp;rules&nbsp;<\/strong><\/h3>\n\n\n\n<p>The government\u2019s digital rules group federally regulated private-sector organizations by size:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Large businesses: 500+ employees.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Medium-sized businesses: 100\u2013499 employees.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Small businesses: 99 or fewer employees.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>Medium-sized businesses have fewer requirements than large businesses. Medium-sized businesses must:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ensure their new web pages conform to the ICT Standard.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Provide training to staff involved in developing,&nbsp;maintaining, or&nbsp;purchasing&nbsp;digital technologies.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Meet the record retention requirements.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>However, medium-sized businesses are not subject to the digital rules for mobile applications, digital documents, procurement, or accessibility statements.&nbsp;<\/p>\n\n\n\n<div style=\"height:39px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading has-black-color has-text-color has-link-color has-large-font-size wp-elements-a84f065645f67f5f561223a691ea63c2\"><strong>Standards for ACA Digital Accessibility Compliance\u00a0<\/strong><\/h2>\n\n\n\n<p>The ACA\u2019s digital technology requirements reference CAN\/ASC-EN 301 549 as the technical benchmark for accessible ICT.&nbsp;<\/p>\n\n\n\n<p><strong>How CAN\/ASC-EN 301 549 relates to EN 301 549 in Europe&nbsp;<\/strong><\/p>\n\n\n\n<p>If your teams are already familiar with European Union (EU) accessibility frameworks, this should feel familiar: the Canadian standard is closely aligned with the EN 301 549 approach used across the EU ecosystem.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-87880808e2714b11fb9414a2f86b4485\"><strong>How CAN\/ASC-EN 301 549 relates to the Web Content Accessibility Guidelines (WCAG)<\/strong><\/h3>\n\n\n\n<p><a href=\"https:\/\/allyant.com\/compliance\/wcag-web-content-accessibility-guidelines\/\" title=\"\">WCAG<\/a> is a major part of the foundation, but ACA digital compliance is not \u201cWCAG-only\u201d:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>WCAG work covers&nbsp;a large portion&nbsp;of what EN 301 549 expects for web content.&nbsp;<\/li>\n\n\n\n<li>EN 301 549 is broader than WCAG and is designed to apply across ICT products and&nbsp;service,&nbsp;including expectations that show up in documents, software, and procurement.<\/li>\n<\/ul>\n\n\n\n<p>In other words: WCAG conformance is often necessary, but ACA compliance usually requires a wider governance and procurement lens.&nbsp;<\/p>\n\n\n\n<div style=\"height:39px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading has-black-color has-text-color has-link-color has-large-font-size wp-elements-e662e4402c9ea9cd3c92f2bd1a011a0d\"><strong>ACA\u00a0Reporting and\u00a0Documentation\u00a0Requirements<\/strong><\/h2>\n\n\n\n<p>ACA compliance is more than fixing&nbsp;issues\u2014it&#8217;s&nbsp;also about&nbsp;demonstrating&nbsp;a repeatable program.&nbsp;<\/p>\n\n\n\n<p>Most covered organizations must:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Publish an accessibility plan (what barriers you will address and how).&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Publish a feedback process (how people can&nbsp;submit&nbsp;accessibility feedback).&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Publish progress reports (what&nbsp;you\u2019ve&nbsp;completed and&nbsp;what\u2019s&nbsp;next).&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Notify the Accessibility Commissioner after publishing required materials.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ensure required publications are accessible and readable (including plain language expectations).&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Keep required records and be prepared to provide them during an inspection.&nbsp;<\/li>\n<\/ul>\n\n\n\n<div style=\"height:39px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading has-black-color has-text-color has-link-color has-large-font-size wp-elements-d9f3601485239c99389beea236487bf2\"><strong>Deadlines for ACA\u00a0Digital\u00a0Accessibility\u00a0Compliance\u00a0<\/strong><\/h2>\n\n\n\n<p>The digital technology requirements roll out in phases, with key milestones in December 2027 and December 2028, depending on organization type and size. Where medium-sized&nbsp;organizations are excluded (mobile, documents, procurement, statements),&nbsp;that\u2019s&nbsp;intentional\u2014those requirements apply to the federal public sector and\/or large businesses.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-efb3db23eb569a2e3459a9d14e1b46c1\"><strong>Web&nbsp;pages (public-facing tools such as inspections, orders, and notices of violation.
